These Terms and Conditions ("Terms") govern your use of services provided by BuyCellFix, operated by 9516-7763 Québec inc. (Laval) and 9524-4257 Québec inc. (Montreal), including device repair, diagnostics, trade-ins, device purchases, and related services at all our locations and through our website buycellfix.ca. By using our services, you agree to these Terms.

1. Repair Authorization

By submitting a device for repair at any BuyCellFix location, you authorize us to:

• Open, inspect, and diagnose your device.
• Perform the agreed-upon repair(s) after you approve the quote.
• Use replacement parts (OEM-equivalent or genuine, depending on availability) to complete the repair.

We will not proceed with any paid repair without your explicit verbal or written approval of the quoted price. You may decline the repair at any time before work begins at no charge.

2. Free Diagnostic

All device diagnostics at BuyCellFix are free of charge. If you choose not to proceed with the repair after receiving the diagnosis and quote, you may collect your device with no obligation and no fee. Diagnostic findings are provided as professional assessments and are not guaranteed to identify every possible issue with a device.

3. Pricing and Payment

• All prices quoted are in Canadian dollars (CAD) and include applicable taxes unless stated otherwise.
• Repair prices are based on the initial diagnostic. If additional issues are discovered during repair, we will contact you for approval before proceeding with any extra work or charges.
• Payment is due upon completion of the repair and before device pickup.
• We accept cash, debit, and major credit cards.

4. Warranty on Repairs

The warranty does NOT cover:

• New damage caused after the repair (drops, water damage, physical impact, unauthorized modifications).
• Issues unrelated to the original repair.
• Devices that have been repaired or opened by a third party after our service.
• Software issues, viruses, or data loss.
• Cosmetic damage (scratches, dents) not part of the original repair.
• Damage caused by misuse, neglect, or unauthorized accessories.

To claim warranty service, bring the device to any BuyCellFix location with your original receipt or repair confirmation.

5. Data and Privacy During Repair

BuyCellFix is not responsible for any data loss during repair. While we take reasonable precautions to preserve your data, certain repairs (screen replacement, motherboard work, water damage recovery, software restoration) carry inherent risk of data loss.

• We strongly recommend backing up your device before bringing it in for repair.
• We do not access, copy, transfer, or view personal data on your device unless required for diagnostic purposes and with your consent.
• Passwords and lock screen codes may be required for testing purposes. Any codes provided are used solely for repair verification and are not stored after service completion.

6. Device Abandonment

If you fail to pick up your device after repair or diagnostic:

• We will attempt to contact you using the phone number and/or email provided at intake.
• If your device remains unclaimed for 60 days after we notify you that it is ready, it will be considered abandoned.
• Abandoned devices become the property of BuyCellFix and may be recycled, resold, or disposed of at our discretion.
• Any outstanding repair charges remain payable regardless of abandonment.

We strongly encourage timely pickup of all devices.

7. Trade-In and Device Sales

When you sell or trade in a device to BuyCellFix:

• You confirm that you are the legal owner of the device or are authorized to sell it.
• You confirm that the device is not stolen, blacklisted, subject to an active financing plan, or under any legal claim.
• The quoted trade-in value is based on the condition of the device at the time of assessment. If the actual condition differs from what was described, the offer may be adjusted.
• All trade-in sales are final once payment is issued and the device is surrendered.
• We reserve the right to refuse any trade-in at our discretion.

BuyCellFix performs IMEI verification on all devices received. If a device is found to be stolen or blacklisted, it will be reported to the appropriate authorities.

8. Refurbished Device Purchases

Refurbished devices sold by BuyCellFix:

• Have been tested, inspected, and restored to working condition.
• May show minor cosmetic signs of previous use (light scratches, minor wear) unless listed as "like new."
• Come with a warranty as specified at the time of purchase.
• Are sold as-is in terms of software — we do not guarantee specific software versions or update compatibility.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• BuyCellFix's total liability for any claim arising from our services shall not exceed the amount you paid for the specific repair or service in question.
• We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of use.
• We are not liable for pre-existing defects, hidden damage, or issues not identified during the initial diagnostic.
• We are not responsible for damage caused by third-party parts, software, or accessories not provided by BuyCellFix.

10. Third-Party Parts

Depending on availability, repairs may use OEM (original equipment manufacturer) or high-quality third-party replacement parts. We use parts that meet or exceed manufacturer specifications. If you require genuine OEM parts specifically, please request this at the time of intake — availability and pricing may differ.

11. Right to Refuse Service

BuyCellFix reserves the right to refuse service at our discretion, including but not limited to:

• Devices suspected of being stolen or involved in illegal activity.
• Devices with hazardous conditions (severely swollen batteries, chemical contamination).
• Customers who are abusive, threatening, or disruptive to staff or other customers.
• Repairs that we determine cannot be completed safely or reliably.

12. Quebec Consumer Protection

These Terms are subject to the Consumer Protection Act (Loi sur la protection du consommateur) of Quebec. Nothing in these Terms is intended to limit or exclude any rights you may have under Quebec consumer protection legislation. In the event of a conflict between these Terms and applicable Quebec law, the law prevails.

13. Website Use

By using buycellfix.ca, you agree to:

• Use the website for lawful purposes only.
• Not attempt to interfere with the website's operation or security.
• Accept that website content (text, images, design) is the property of BuyCellFix and may not be reproduced without written permission.

Online quotes and pricing displayed on the website are estimates and may vary based on in-person diagnostic.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any disputes arising from these Terms shall be resolved in the courts of the Province of Quebec.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
